You must be legally able to enter into these terms and must provide accurate account information. You are responsible for activity under your account and for keeping credentials, tokens, machines, and workspace access secure.

If you use Orchard for an organization, you represent that you have authority to accept these terms for that organization.

You keep ownership of content you submit, upload, connect, or generate through Orchard, subject to any rights held by others.

You grant Orchard permission to host, process, transmit, display, reproduce, and otherwise use your content as needed to provide, secure, support, and improve the service.

You are responsible for your content, including code, files, logs, prompts, outputs, secrets, and any third-party materials you choose to process with Orchard.

Do not use Orchard to break the law, violate rights, compromise systems, distribute malware, interfere with service operation, reverse engineer restricted service components, bypass usage limits, or access data or systems without authorization.

Do not upload or process regulated, highly sensitive, or illegal content unless you have confirmed that your Orchard plan and configuration are appropriate for that use.

Orchard may connect your prompts, files, logs, messages, context, and other content to AI models and automation tools. AI outputs can be inaccurate, incomplete, unsafe, or unsuitable for your use case.

You are responsible for reviewing, testing, and approving AI-generated output before relying on it, deploying it, publishing it, or using it in production or high-risk contexts.

During beta, Orchard may collect, retain, review, and use engine logs, diagnostic events, crash data, session metadata, prompts, outputs, file paths, command output, and related operational data to debug issues, evaluate reliability, improve product behavior, and develop the application.

Beta engine logs and diagnostic data should not be treated as private, confidential, or isolated from Orchard review. Do not use beta builds to process secrets, regulated data, confidential client materials, or other sensitive content unless you are comfortable with that data appearing in logs used to improve the application.

Orchard integrates with third-party services such as authentication providers, model providers, repositories, payment processors, infrastructure providers, and other tools you authorize.

Third-party services are governed by their own terms and policies. Orchard is not responsible for third-party services, content, availability, or actions.

Paid features may require a subscription or usage-based fees. You authorize Orchard and its payment processors to charge applicable fees, taxes, and renewals using your selected payment method.

Fees are non-refundable except where required by law or stated in a separate written agreement.

We may modify, suspend, or discontinue features, impose reasonable limits, or update these terms. We will try to provide notice when changes materially affect your use of Orchard.

We may suspend or terminate access if we believe you violated these terms, created security or legal risk, failed to pay amounts owed, or used Orchard in a way that could harm the service or others.

Orchard is provided as is and as available. To the maximum extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation.

To the maximum extent permitted by law, Orchard will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business interruption.
